“Judge Edward Rubin, a Louisiana judge, has ruled that the state’s ban on same-sex marriage is unconstitutional…” on the basis that the 14th Amendment of the U.S. Constitution requires that states give “full faith and credit” to each other’s laws.
Angela Costanza and her partner, Chastity Brewer was married in California in a same-sex wedding. But Louisiana’s law does not recognize same-sex marriages performed in other states. The two women filed a lawsuit in Lafayette asking that the state be required to recognize their marriage.
Costanza also wanted to adopt Brewers’ 9-year old son and be listed on his birth certificate, even though she is not his biological mother. But Louisiana’s law did not permit it until Rubin’s ruling.
