Judge says Constitution Outdated, No Value in Studying It

Seventh Circuit Judge Richard Posner says U.S. judges should stop studying the Constitution. “I see absolutely no value to a judge of spending decades, years, months, weeks, day, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments and its implementation,” Posner said. “Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century, which means that the original Constitution, the Bill of Rights, and the post-Civil War amendments (including the 14th), do not speak to today,” he added.

Posner, who has served as a federal judge for thirty-five years, said in the 2015 colloquium, “I don’t believe that any document drafted in the 18th century can guide our behavior today.”

Jurisprudence in the United States is on shaky ground when a federal judge openly disregards the U.S. Constitution.

The United States, “shall repudiate every principle of its Constitution as a Protestant and republican government, and shall make provision for the propagation of papal falsehoods and delusions….” Testimonies for the Church, Vol. 5, page 451.
