Nevada’s Attorney General Changes Position on Same-Sex Marriage

Nevada’s Attorney General, Catherine Cortez Masto, did a flip flop three days after strongly defending Nevada’s ban on same-sex marriage, saying that her arguments were “likely no longer tenable” in light of a San Francisco federal appeals court decision in handed down on the same day as her brief.  

Masto re-evaluated her position because the San Francisco court raised the level of scrutiny for all distinctions drawn on the basis of sexual orientation. In other words, the court made it harder for legal entities to make distinctions based on sexual orientation, which will make it easier for homosexuals in legal issues, at least in the 9th circuit. 

But the 9th circuit court’s decision could well set precedence for other circuits. While constitutional challenges to legal barriers against same-sex marriage wend their way to the Supreme Court, the lower courts, and law enforcement officials like Ms. Masto, continue to expand legal support for same-sex marriage. It is only a matter of time before the United States will, as a nation, join other nations in upholding same-gender marriages.
