Australian ACT Joins the Race to the Bottom on Same-Sex Marriage

The Australian Capital Territory (ACT), which is similar to Washington DC, may pass a law approving same-sex marriage in the next few weeks. The law is certainly to be challenged by the Commonwealth Attorney-General in the High Court.

“It would be better for all concerned if the ACT government waited for a short time until the validity of the proposed law was determined by the High Court,” Senator George Brandis, Commonwealth Attorney-General said on Thursday.

There is strong support for the law in the ACT legislative assembly, so the ACT is not likely to delay implementation. The first same-sex marriage could happen in December.

Those who support the law are suggesting that the more same-sex marriages entered before the court challenge is processed would increase the difficulty in overturning or undoing the law. “I would encourage as many same-sex couples to get married in the ACT as possible,” said the chair of the Australian Marriage Equality organization and independent New South Wales MP Alex Greenwich. “The more people we have expressing their love and commitment will make it harder for any laws to be overturned,” he said.
