Alabama Judge Ordered to Issue Same-sex Marriage Licenses

U.S. District Judge Callie Granade ordered an Alabama official to issue marriage licenses to same-sex couples in Mobile County, AL, where same-sex couples were unable to marry because local probate judge Don Davis, had refused to issue marriage licenses.

Justice Granade had overturned a state-wide ban on gay marriage in January but then Alabama Chief Justice Roy Moore issued a contravening order instructing Alabama probate judges not to issues the licenses because he said the ruling of Justice Granade didn’t apply to local probate judges. Justice Davis was acting on Moore’s order when he refused to issue the licenses.

Alabama is the 37th state to legalize same sex marriage. A nationwide ruling is expected from the U.S. Supreme Court later this year.

The battle for gay rights rages on. The U.S. Supreme court has decided it would not stop gay marriages, and a more definitive nationwide ruling is expected later this year.
